movewithmomentum.com (the "Site") is owned and operated by Move With Momentum LLC ("Move With Momentum," "we," "us," or "our"), which acts as the operator of the Site and the controller of the personal information described here. Real estate brokerage services referenced on the Site are provided by Momentum Realty, a real estate brokerage licensed in Florida and Georgia. This policy is issued by Move With Momentum LLC as operator of the Site.

2. Information we collect

Information you give us

When you submit a lead, contact, home-valuation, or agent-recruiting form, or otherwise reach out to us, you may provide:

If you check a box giving us consent to contact you by phone, text, or email, we also record, as proof of that consent: the date and time of your submission (UTC), the IP address the form was submitted from, your browser user agent, the exact consent language and version shown to you, the communication channels you agreed to, the form web address, and the name, phone number, and email you provided. We keep these consent records as evidence that you opted in. Consent is never a condition of using the Site or of any purchase or service.

Information we collect automatically

When you visit the Site, we and our analytics providers may automatically collect:

Information from other sources

Listing data shown on the Site, including data displayed through our IDX or MLS integration, is provided by one or more Multiple Listing Services and reflects listing and property information from those sources rather than information about you. If you arrive through a third-party advertising or referral source, that source may pass along limited information about how you reached us. [CONFIRM WITH COUNSEL: whether any third-party lead source or data enrichment vendor supplies additional personal information about visitors.]

3. How we use your information

We use the information above to:

We do not use the information you provide to make decisions about you based on race, color, religion, national origin, sex, familial status, disability, or any other characteristic protected by fair housing law.

4. Text messages and phone calls (TCPA and Florida law)

If you check the consent box on a form, you give your prior express written consent for Move With Momentum LLC and Momentum Realty and their agents to contact you by phone call, text message, and email at the number and address you provided, for marketing and service purposes. The specific consent language shown to you at the time you submitted the form controls what you agreed to.

SMS opt-in data is not shared. The mobile information you provide when you opt in to text messaging, including your consent to receive texts, will not be shared with or sold to third parties for their own marketing purposes. This is separate from the operational service providers described in Section 6, who process information only to help us deliver the messaging service. See our SMS and Messaging Terms for the full messaging program terms.

5. Cookies and analytics

The Site uses cookies and similar technologies to operate the Site, remember preferences, and measure traffic and engagement. We use Google Analytics (gtag) to understand how visitors use the Site; Google Analytics sets cookies and processes usage and device data on our behalf. [CONFIRM WITH COUNSEL: the complete list of analytics, advertising, and tag-management vendors actually deployed and whether any advertising or remarketing cookies are used.]

You can control cookies through your browser settings, and you can opt out of Google Analytics using the Google Analytics opt-out browser add-on. Some browsers offer a "Do Not Track" or Global Privacy Control signal; [CONFIRM WITH COUNSEL: whether and how the Site honors Global Privacy Control / opt-out preference signals, which several state laws treat as a valid opt-out of sharing.]

6. Service providers and third parties we share with

We share personal information with service providers that process it only to perform services for us, under contract and not for their own purposes. These currently include:

We may also disclose information to comply with law, respond to lawful requests, enforce our terms, or protect the rights, property, or safety of any person, and in connection with a business transfer such as a merger or sale. [CONFIRM WITH COUNSEL: the complete and current vendor list, including any CRM, email service provider, payment processor, or advertising partner, and whether a data processing agreement is in place with each.]

We do not authorize our service providers to use your information for their own marketing.

7. Sale or sharing of personal information

[CONFIRM WITH COUNSEL: whether the company sells or "shares" personal information as those terms are defined under the California Consumer Privacy Act as amended (CCPA/CPRA) and the Florida Digital Bill of Rights, including whether the use of advertising or analytics cookies constitutes "sharing" for cross-context behavioral advertising.] As a placeholder pending that confirmation: we do not sell your personal information, and we do not share it for cross-context behavioral advertising. If this changes, we will update this policy and provide a "Do Not Sell or Share My Personal Information" mechanism.

8. Your privacy rights

California residents (CCPA / CPRA)

If you are a California resident, you have the right to know what personal information we collect, use, and disclose; to request access to and a copy of that information; to request correction of inaccurate information; to request deletion; and to opt out of any sale or sharing of personal information and to limit the use of sensitive personal information. You also have the right not to be discriminated against for exercising these rights.

Florida residents (Florida Digital Bill of Rights)

If you are a Florida resident, and to the extent the Florida Digital Bill of Rights applies to us, you have the right to confirm whether we process your personal data and to access it; to correct inaccuracies; to delete personal data; to obtain a portable copy; and to opt out of the processing of your data for targeted advertising, the sale of your data, or certain profiling. [CONFIRM WITH COUNSEL: whether Move With Momentum LLC meets the applicability thresholds of the Florida Digital Bill of Rights; if not, this section may be offered as a courtesy rather than a statutory obligation.]

How to exercise your rights

To make any of these requests, contact us using the information in Section 12. We will verify your request before acting on it and will respond within the timeframes required by applicable law. You may use an authorized agent to submit a request where the law allows. To opt out of marketing calls, texts, or emails specifically, see Section 4.

9. Children's privacy

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly collect personal information from minors under 16 for sale or sharing. If you believe a child has provided us personal information, contact us and we will delete it.

10. Data security and retention

We use reasonable administrative, technical, and physical safeguards intended to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain personal information for as long as needed for the purposes described in this policy and as required by law. Consent records for phone, text, and email outreach are retained as evidence of opt-in for the period required to defend against claims. [CONFIRM WITH COUNSEL: specific retention periods for lead records, consent records, and analytics data, and the retention period for TCPA/FTSA consent proof (the consent spec recommends at least 5 years).]

11. Changes to this policy

We may update this policy from time to time. When we make material changes, we will update the effective date below and post the revised policy on this page. Your continued use of the Site after an update means you accept the revised policy.
