The old answer — “the seller pays everything” — was always a simplification, and since 2024 it is officially obsolete. Updated October 28, 2026. Who pays is still a matter of negotiation, set out in the listing agreement and the buyer's written agreement with their agent. The market context for that negotiation has shifted: Statewide, Florida MLS records show 22,949 closings in September 2026 against 23,376 a year earlier, with the median seller closing at 94.9% of the original asking price (93.8% a year earlier).

In the Jacksonville market, sellers closed at a median 96.1% of original asking in September 2026. Where a seller is already giving up several points, a concession toward the buyer's agent fee is often easier to agree than a further price cut, because it can be structured inside the same offer.

Can a buyer ask the seller to pay their agent's fee in a Florida offer?

Yes. The offer can ask the seller to pay the buyer's agent directly or to give a credit at closing, and the seller can accept, counter or refuse. Lender limits on seller concessions apply, so confirm the cap for your loan type before writing the offer.
